For sales and deliveries, unless otherwise expressly agreed upon, the following terms and conditions shall apply in their version valid at the time of the order.
- Scope
These general terms and conditions apply to all contracts between Andrea Cecconi (“CECCONI”) and its consumers. Agreements differing from these General Terms and Conditions shall only be accepted if these have been expressly agreed in writing in advance.Consumers are any natural person who enters into a legal transaction for purposes which cannot be attributed primarily to their commercial or independent occupation. Entrepreneur is a natural or legal person or a legal person who is acting in the exercise of his commercial or independent professional activity when a legal transaction is concluded.These terms and conditions also apply to future business relations with entrepreneurs, without CECCONI being obliged to refer to them again. If the contractor uses opposing or supplementary general terms and conditions of business, the validity thereof is hereby contradicted; They will only become part of the contract if CECCONI has expressly consented to this.
- Contract closing
CECCONI offers products for sale via its own website. In the case of purchases on the CECCONI website, the contract is concluded with the sending of the order confirmation by CECCONI by e-mail to the customer. On the CECCONI website, the customer has the opportunity to correct input errors by checking his / her input before submitting a binding purchase offer.
- Purchase processing
CECCONI accepts the payment terms stated in the description of the item. CECCONI has the right, in particular, to demand advance payment by wire transfer. The use of the payment service PayPal is optional and not mandatory. The customer must specify the order number which he receives from CECCONI in the order confirmation during the wire transfer. After receipt of payment, CECCONI will deliver the goods to the customer within 5 working days, unless otherwise agreed. The customer agrees with the dispatch of the goods by Österreichische Post AG or a commercial parcel service at the choice of CECCONI.
- Contract language, contract text storage
the languages available for the contract are German and English. CECCONI stores the contract text and sends you the order data by e-mail. You can view and download the terms and conditions at any time on this page. You can see your past orders in your customer account.
- Prices and shipping charges
The purchase price is calculated according to the fixed price by CECCONI. The prices given by CECCONI include the statutory value-added tax according to the Austrian Value Added Tax Act. In addition to the purchase price, the customer has to bear the shipping costs stated in the item description for each purchased item. A reduction of the shipping costs for the simultaneous purchase of several articles is only valid if this discount has been mentioned separately in the article description.
- Transport damage
For consumers:
If goods are delivered with apparent transport damage, please report the damage immediately to the delivery company and contact CECCONI as soon as possible. The non-compliance of a complaint or contact has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, they help CECCONI to assert its own claims against the freight carrier or the transport insurance.For entrepreneurs, the following applies:
The risk of accidental loss and accidental deterioration will be transferred to you as soon as CECCONI has delivered the goods to the freight forwarder, freight carrier or other person or institution who is designated to carry out the shipment. Among merchants, the obligation to investigate and to notify the seller is governed by § 377 HGB. If you fail to comply with the advertisement provided there, the goods shall be deemed to be approved, unless this is a defect that was not apparent during the inspection. This does not apply if CECCONI has fraudulently concealed a defect.
- Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which can be found here ec.europa.eu/consumers/odr. Consumers have the opportunity to use this platform for the settlement of their disputes.In order to settle disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, CECCONI is obliged to participate in dispute settlement proceedings before a consumer-enforcement agency. Responsible is: Conciliation for Consumer Contracts, Mariahilfer Straße 103/1/18, 1060 Vienna, Austria, www.verbraucherschlichtung.at. CECCONI will participate in a dispute settlement procedure before this authority.
- Final clauses
This contract and all rights and obligations arising therefrom between the customer and CECCONI shall be subject to Austrian law to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods and the Provisional Standards. Disputes are to be carried out before the court of jurisdiction for the first district in Vienna, insofar as a court agreement is admissible.
